IMPORTANT NOTICE IN TERMS OF THE CONSUMER PROTECTION ACT
Participation in Brazilian Jiu-Jitsu, Muay Thai, and related martial arts activities involves significant physical contact and inherent risks, including but not limited to serious injury, joint injury from locks, choking techniques (strangulation), injuries arising from falls, throws, and takedowns, and injuries resulting from striking techniques including punches, kicks, elbows, knees, and pad/bag work.
By booking and attending a trial class at HB BJJ (Pty) Ltd - The Gentle Art Academy, I acknowledge that I have been specifically made aware of these risks and that I voluntarily choose to participate.
ASSUMPTION OF RISK
I confirm that I participate entirely at my own risk and accept full responsibility for any injury, loss, or damage that may occur as a result of my participation or presence at the academy.
MEDICAL FITNESS AND HEALTH DECLARATION
I declare that I am physically fit to train and that I am not aware of any pre-existing medical condition, injury, or illness that would make participation inadvisable without prior medical clearance. I understand that it is my responsibility to disclose any known medical conditions or injuries to the academy's instructors before participating, and to seek medical advice prior to participation if necessary.
I further confirm that I am not knowingly suffering from any communicable illness or condition that could be transmitted to other participants through physical contact.
MINORS — PARENTAL / GUARDIAN CONSENT
Where the participant is under 18 years of age, this form must be completed and signed by a parent or legal guardian. By accepting below, the parent or legal guardian confirms that they consent to the minor's participation, have read and understood all terms herein on behalf of the minor, and accept all associated risks and liability on the minor's behalf. The academy reserves the right to refuse participation to any minor where valid parental or guardian consent cannot be confirmed.
WAIVER AND INDEMNITY
To the fullest extent permitted by South African law, I hereby waive and release HB BJJ (Pty) Ltd, its owners, instructors, employees, and representatives from any liability for injury, loss, or damage arising from my participation or presence at the academy.
I further indemnify and hold harmless HB BJJ (Pty) Ltd and its representatives against any claims arising from such participation.
This exclusion of liability does not apply to gross negligence or any liability which cannot legally be excluded.
RULES AND SAFETY
I agree to follow all safety instructions, training guidelines, and academy rules at all times.
PERSONAL PROPERTY
I understand that the academy is not responsible for the loss or damage of personal property brought onto the premises.
MEDICAL CONSENT
In the event of an injury or medical emergency, I consent to receiving necessary medical treatment and accept responsibility for any associated costs.
ELECTRONIC ACCEPTANCE
By ticking the acceptance box and submitting this form, I confirm that I have read, understood, and agree to this Acceptance of Risk & Liability and the Mat Rules, that the risks and limitations above were specifically drawn to my attention before acceptance, and that I freely and voluntarily agree to all terms. This electronic acceptance is legally binding in terms of the Electronic Communications and Transactions Act 25 of 2002 and constitutes my signature.
